These Terms of Service ("Terms") constitute a legally binding agreement between you and Beijing Xingjinxing Trading Co., Ltd ("XingJinXing", "Company", "we", "us", or "our") regarding your use of our website, mobile applications, games, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Business Cooperation & Service Models

XingJinXing operates under three primary business models, each governed by specific operational standards:

• Project Operations (Agency): We provide comprehensive management and publishing services for third-party mobile applications and games. This includes user acquisition, community management, and global market scaling.
• Project R&D (Development): We offer professional technical research and development services. All custom development projects are subject to individual Master Service Agreements (MSA) and Statements of Work (SOW).
• Self-Developed Operations: We develop and operate our own portfolio of mobile applications and games, utilizing various monetization strategies including in-app subscriptions, virtual items, and ad mediation.

2. User Accounts & Responsibilities

You may be required to create an account to access certain Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information and to keep it updated.

3. In-App Purchases & Monetization

Our Services may include virtual currency, items, or premium features ("Virtual Goods"). All transactions for Virtual Goods are processed through the official payment systems of the Google Play Store or Apple App Store.
- Payments are non-refundable unless required by law or the respective app store's policies.
- We reserve the right to manage, regulate, control, or modify Virtual Goods at any time.

4. Intellectual Property Rights

All software, designs, logos, artwork, text, and other materials provided through our Services are the exclusive property of Beijing Xingjinxing Trading Co., Ltd or its licensors. No license is granted to you except for the limited, non-transferable right to use the Services for personal, non-commercial purposes.

5. Age Requirements & Protection

You must be at least the minimum age required by your jurisdiction to use our Services (typically 13 years old, or older where required by local law). If you are under the age of majority, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

6. Prohibited Conduct

You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of our apps.
- Use cheats, automation software (bots), hacks, or any unauthorized third-party software to modify the Services.
- Post content that is infringing, defamatory, or violates any law.

7. Legal Disputes & Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms, including the validity, invalidity, breach, or termination thereof, shall be settled in accordance with the following:

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without giving effect to any principles of conflicts of law.
• Arbitration: Any dispute shall be submitted to the Beijing Arbitration Commission (BAC) for arbitration, which shall be conducted in accordance with the Commission's arbitration rules in effect at the time of applying for arbitration. The seat of arbitration shall be Beijing. The language of the arbitration shall be Chinese.
• Jurisdiction: To the extent that arbitration is not applicable, you agree to the exclusive jurisdiction of the competent courts in Miyun District (Cluster Registration), Beijing, China.

8. Limitation of Liability

To the maximum extent permitted by applicable law, XingJinXing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
